Terms of Service

These Terms define the relationship between you and Caelbert Chae when you use CaelbertChae.com, NaviMind, or another service that links to these Terms. They explain what you can expect from us and what we expect from you.
1. About these Terms
These Terms of Service (“Terms”) are an agreement between you and Caelbert Chae, referred to as “Caelbert,” “we,” “us,” or “our.” They apply to CaelbertChae.com, NaviMind, and future products or projects that link to them (collectively, the “Services”).
By accessing or using a Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services. Service-specific terms may supplement these Terms; if there is a conflict, the specific terms control for that service.
2. Eligibility
You must be at least 16 years old and legally capable of entering into these Terms. If the law where you live requires a higher age or valid parental or guardian authorization, that requirement applies. If you use a Service for an organization, you confirm that you are authorized to bind it.
3. Accounts and security
- Provide accurate information and keep it reasonably current.
- Keep your password, verification codes, recovery links, and devices secure. Do not share credentials or permit unauthorized use.
- You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures.
- Notify us promptly at privacy@caelbertchae.com if you suspect unauthorized access.
- We may require identity or account verification before processing sensitive requests.
4. Your right to use the Services
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal or internal business purposes. This right does not transfer ownership of the Services, software, designs, brands, or other intellectual property.
Features may be experimental, beta, incomplete, or changed as we develop the Services. Do not rely on a beta feature for safety-critical, emergency, medical, legal, financial, or other high-risk decisions.
5. Your content and data
You retain ownership of content you submit, save, or create. You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, transmit, format, and process that content only as reasonably necessary to operate, secure, maintain, and improve the Services, comply with law, and follow your sharing instructions. This license ends when the content is deleted from our systems, except where limited retention is permitted by the Privacy Policy or law.
You are responsible for your content and confirm that you have the necessary rights and permissions to upload, use, share, or publish it. Do not add another person’s contact details, confidential information, or personal data without a lawful basis or authorization.
6. Shared and public features
When you share a Space, resource, comment, family category, or public-library item, you direct us to make it available to the audience you select. Public content can be viewed, copied, linked, or reshared by others. Check the audience and content before publishing. We may remove or restrict content that violates these Terms, law, safety, privacy, or another person’s rights.
7. Acceptable use
You must not, and must not help another person to:
- Use the Services unlawfully, fraudulently, deceptively, or to harm, threaten, harass, exploit, or impersonate anyone.
- Upload malware, interfere with operation, bypass security or access controls, probe vulnerabilities without written permission, or overload the Services.
- Access another person’s account or data without authorization, scrape non-public information, or collect personal data unlawfully.
- Infringe intellectual property, privacy, publicity, confidentiality, or other rights.
- Use automated means to create accounts, send spam, manipulate usage, or extract content beyond ordinary personal use without written permission.
- Reverse engineer or circumvent technical restrictions except where applicable law expressly permits it.
- Use the Services for decisions or activities where failure could reasonably cause death, personal injury, or serious physical or environmental harm.
8. Optional integrations and AI features
If you connect a third-party service or AI provider, you authorize the information necessary for your request to be sent to that provider. Its terms, privacy policy, availability, and charges may apply independently. You are responsible for protecting any API key or credential you provide.
AI-generated or automated output may be inaccurate, incomplete, or unsuitable. Review important output before using or sharing it. The Services do not provide legal, medical, financial, or other professional advice.
9. Intellectual property and feedback
The Services and their original software, visual design, logos, text, and other materials are owned by or licensed to Caelbert Chae and are protected by applicable laws. You may not copy, publish, sell, sublicense, or create derivative works from them except as permitted by law or written authorization.
If you provide feedback, you allow us to use it without restriction or payment, but you retain ownership of any underlying content or intellectual property you already own.
10. Privacy and browser storage
Our Privacy Policy explains how we handle personal data. Cookie Settings explains cookies and similar browser storage and gives you available controls. By using the Services, you acknowledge those notices.
11. Service changes, availability, and communications
We may add, modify, suspend, or discontinue features to maintain security, comply with law, improve the Services, or manage technical constraints. We aim to provide reasonable notice when a change materially affects an established service, but emergency security or legal changes may occur without advance notice.
Services may sometimes be unavailable or contain errors. We do not guarantee uninterrupted operation, preservation of every feature, or compatibility with every device. Keep independent copies of information you cannot afford to lose.
We may send transactional communications needed for account verification, security, recovery, sharing invitations, or important service notices. Marketing messages, if ever offered, will require the choice provided by applicable law.
12. Suspension and account deletion
You may stop using the Services at any time. NaviMind currently provides an 18-day recovery period after an account-deletion request. During that period, you may cancel deletion where the feature is available. After the recovery period, associated server-side data is scheduled for permanent deletion as described in the Privacy Policy.
We may restrict or suspend access when reasonably necessary to address a security risk, legal requirement, material breach, abuse, or harm to another person or the Services. When appropriate, we will provide notice and an opportunity to appeal or correct the issue.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Caelbert Chae will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, opportunities, or data arising from the Services.
Our total liability for claims relating to a Service will not exceed the greater of the amount you paid us for that Service during the 12 months before the event giving rise to the claim or US$100. These limitations do not apply to liability that cannot be limited by law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.
15. Governing law and disputes
These Terms are governed by applicable laws of the United States and applicable state law, without designating an exclusive state until a service-specific notice states otherwise. Mandatory consumer protections in the country or state where you live remain unaffected.
Before filing a formal claim, you and Caelbert agree to make a reasonable good-faith effort to resolve the issue by emailing privacy@caelbertchae.com. If it cannot be resolved, either party may bring the claim before a court of competent jurisdiction. These Terms do not require arbitration and do not prevent either party from seeking urgent injunctive relief.
16. General provisions
If part of these Terms is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a legitimate reorganization or transfer of a Service, subject to applicable law. These Terms, the Privacy Policy, Cookie Settings, and any service-specific terms form the agreement concerning the Services.
17. Changes and contact
We may update these Terms as the Services or law changes. We will post the revised date and provide additional notice where required. Continued use after an effective update constitutes acceptance only to the extent permitted by law.
